Base Erosion and Profit Shifting: What is it and why is it Important?

There is a growing chorus among governments of both developed and emerging countries that there is a mismatch between corporate economic activity and corporate taxation, referred to as 'base erosion.' In February the OECD issued an initial report, entitled "Addressing Base Erosion and Profit Shifting" (the BEPS Report) which was requested by the G20 meeting in Mexico City last year. The BEPS Report proposes a holistic framework to define the base erosion "problem" and to pursue coordinated tax policy solutions. This OECD initiative is moving fast and the OECD has proposed to release a BEPS "action plan" in time for the next G20 meeting in July. Join our speakers as they discuss the history of the base erosion discussion, content of the Report, the various reactions to the Report, examples of structures which the Report has targeted, and implications for US companies with cross-border transactions.
